I recently received mortgage instructions from an established lender of last resort.

I did not recognise the client name or address and phoned the proposed mortgagee and asked where the client had come from. I was given a broker's name and number to telephone, which was not too far from where I practise. I called the given number and asked about 'my client' as I had no knowledge of him.


I was told it was a mistake and the client had actually instructed someone else of a similar name to myself, but incidentally while I was on the telephone, could I give an indication of my fees.


The broker seemed to think that what I quoted was going to be far better than the quote from my namesake, so would I act and what would the kick-back be.


I asked if the broker meant would I share my fee? Call it what you like, the broker said, you and I know it is a kick-back.
