Land Registry consults on adjudicator referral rules
On 6 January 2003, the Land Registry published a consultation paper on the Land Registration (Referral to the Adjudicator to HM Land Registry) Rules.
Together with new land registration rules, which were the subject of a major consultation last autumn, these rules will support the Land Registration Act 2002 which comes into force on 13 October 2003.
The Act creates the office of the adjudicator to HM Land Registry.
One of the adjudicator's functions will be to determine disputes that have arisen out of an application to the Land Registry, where it is not possible for the parties to reach agreement.
The rules deal with the process by which the disputes are referred to the adjudicator.
They do not cover the detail of the functions of the adjudicator, or the procedures that will apply once a matter has been referred; these will be the subject of separate rules which will be the responsibility of the Lord Chancellor's Department.
The consultation paper contains the draft rules and a commentary.
Views are sought generally on the issues raised in the consultation paper and on the specific matters it contains.
