CEL Group Ltd v Nedlloyd Lines Ltd, The Times 2 January 2004 (CA): a respondent, in order to protect himself against the costs of an appeal, should be able to retain the benefit of the judgment already obtained and should not have to make an offer based on giving up a substantial part of what he was currently entitled to.

Hill v Bailey, The Times 5 January 2004 (ChD): although a funded party remained protected against the making of enforceability orders for the payment of costs, that protection was not available in respect of orders for costs to be used as a set-off.

European Union

Council Regulation (EC) No 2201/2003 of 27 November 2003 concerns jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000.

Known as the 'Brussels III' or 'Brussels II bis' regulation.

Directive 2003/71/EC of the European Parliament and of the Council of 4 November 2003 concerns the prospectus to be published when securities are offered to the public or admitted to trading and amending Directive 2001/34/EC.

This harmonises the drawing up, scrutiny and distribution of prospectuses published when securities are offered to the public or admitted to trading on a regulated market.

Employment Rights (Increase of Limits) Order 2003, SI 2003:3038

This order increases from 1 February 2004 the limits applying to certain awards of employment tribunals, and other amounts payable under employment law, as specified in the schedule to the order.

Landlord and tenant

Regulatory Reform (Business Tenancies) (England and Wales) Order 2003, SI 2003:3096: Amends the Landlord and Tenant Act 1954, part 2 and, among other things, provides that a tenancy to which part 2 applies continues unless terminated in accordance with the provisions of the act and enables the tenant to apply to the court for a new tenancy.

Comes into force on 1 June 2004.
