In response to Stephen Hadrill's comment article (see [2006] Gazette, 9 February, 14), we do not need a new system to deal with compensation. The Civil Procedure Rules (CPR) are well thought out and excellent. They provide for a cards-on-the-table approach and promote the early resolution of claims.
Regrettably, the insurance industry consistently fails to follow the rules. As a personal injury practice, every day we are forced to deal with insurance personnel with little or no regard for the CPR. Time and time again we have to go to court to enforce them. Escalating costs? Time wasting? The last thing we need is a new system run by those who cannot operate the one we have and whose only motive is profit.
