Anon @ 3.19 do you not understand the law of restitution? If my BMW is damaged then I have a right to a similar replacement vehicle and the law already provides limits on 'betterment' and unreasonable conduct by the claimant, see Umerji and the other line of recent cases.

Similarly why should the poor be penalised by having to by fully comp insurance?
