Some McKenzies clearly don't know what their role is. I have seen McKenzie websites using terminologies like 'my client' and 'instruct' on their website, which is not something they should do and makes them look more like pseudo solicitors. To 'instruct' a solicitor is to pass over responsibility to the professional dealing with the matter; it does not mean to 'tell them what to do', as it word 'instruct' more commonly means. McKenzies are not meant to take 'instructions' from their clients, they are there to help, support and assist the LiP who they make clear remains totally responsible for their own case and outcome. It does not surprise me at all to read how solicitors see McKenzies as little more than untrained pseudo solicitors who are gobbling up parts of their work whilst remaining unfairly unregulated. Their perception of McKenzies should be totally different. Let;'s hope the consultation outcome helps bring that about, whether they are paid to do a job or not.
