@10.46 'I was given no opportunity by the insurance company to comment or object and didn’t even know there'd been a claim let alone a payout for about 3 or 4 years' and all because of a 'tiny scratch'

Perhaps you should complain about the way your insurer handled the third party claim. Surely they at least spoke to you about the extent of the damage, or sent you a claim form so you could report your concerns? Did you take photos?

They could have sent it to their panel fraud lawyers for a robust defence. Talking the talk on fraud but not walking the walk - hardly surprising that insurers just want the government to do their job for them on this issue...
