But the UK did give its consent. The security legislation in question was that providing for common standards of protection throughout the EU - which incidentally is far more than a 'trade bloc'. And the UK opted voluntarily into that legislation. Since it has an opt-out from legislation affecting 'justice and home affairs' it did not need to do so, but clearly felt that it was in the interests of the UK to be party to those common rules. And it is the role of the CJEU to adjudicate on the correct interpretation of union-level legislation - which the UK accepted by acceding to the EEC as it then was. So the CJEU was in this instance the correct court to make the ultimate decision. And presumably even Euro-sceptic Mr Davies is happy that he was vindicated in his opposition to this proposal.
