The problem with that suggestion is that people may be presented with the options of staying in an abusive marriage or leaving and becoming destitute. They may not want the abuse to be raised in the divorce, for example for the sake of their children, but they should still have a right to a divorce even if the other party doesn't want to let them leave.

And if that petitioner gave up their career to care for children and now has limited earning potential, while the other party prospered as a result of that arrangement, should they really be forced to walk away with nothing and at such a significant financial disadvantage to their partner?
