I agree that the judge made the right call but I also think the courts should be better funded so they're not open to criticism for missing things too.

My colleague is still waiting for a hearing date on a possession claim which he issued at the beginning of the year; he has regularly chased the court for a date only to be told one is forthcoming. It is now June.

It seems unfair that solicitors are expected to comply lest they be struck out and there is no corresponding incentive for the court to make sure they're on time with things. I imagine it is down to under-funding and "efficiency".
