The government has tried to make it too easy for people to make LPAs.

When the old EPAs had to be registered then a certain group of close relatives had to be notified. Now nobody has to be notified about the making of an LPA. So you could have a parent with a son and daughter who wishes to appoint, say, the son to be their attorney, but with no obligation to notify the daughter. Is it any wonder that the daughter might be annoyed. This could be rectified by reinstating the requirement to notify a close relative.

Also, financial abuse is becoming more frequent, especially by attorneys. Again, this could be rectified by making it compulsory for an attorney to prepare annual accounts and to submit these to the OPG for checking.

These two simple changes will, I am sure, deal with some of the concerns which Denzil Lush saw during his time at the Court of Protection.
