Scott McKenzie, s55 offences involve the sharing of personal data without the consent of the Data Controller. Obviously the Insurer, or their agent, will have had a contract with the CRA and with it the permission to access that data. Irrespective of the involvement of the Data Controller, the obtaining and disclosing is permissible if crime is prevention/ detection is the purpose.

As for 2 years imprisonment....if they didn't jail anyone after Leveson, they aren't going to imprison anyone from an insurance company.
