It seems to me that this issue has arisen partially as a result of getting rid of committal proceedings. There was a lack of understanding of the importance of such a process.
I wonder if Committal proceedings could be reinstated so that a District Judge could oversee the disclosure process BEFORE the case is kicked upstairs and so the Defence could point out defects in the investigation and so the DJ, if it was considered reasonable and proportionate and in the interests of justice could order further enquiries. At such a process a Senior Police officer would be present to answer queries from the DJ.
If the Defendant doesn't object then the process of committal could proceed without further enquires.
In this way Disclosure procedures, CPIA duties and the basic tenets of our Justice system would be observed.
