Brian your last comment shows that these discussions have not taken place and until they do and are acted upon, the protections under the new regime are illusory.

The reality is that there is no protection. The SRA's current position is that it isn't interested, doesn't care, and doesn't want to know. It's someone else's problem. Funny that, as understanding other peoples' problems is a key - if not critical - skill for a Solicitor, but not so for the regulator. The SDT has tied itself in knots, with frankly ridiculous if not absurd moralising. The whole point of the SDT is that the Solicitor member is supposed to be able to bring relevant professional experience to bear, and the lay members are supposed to give independence and a sense check, but it doesn't work like that.
