Yet another reason why Obiter is such a staunch supporter of law firms' right to advertise or market their services has just come in all the way from Mooloolaba in Queensland, Australia. In a seemingly genuine January 2005 newsletter, local law firm Brennans asks a very important question - namely, 'How big is your will?' In a style worthy of the great Frankie Howerd or Viz, we are told that 'with wills as in some other situations in life - size matters'. 'Compare the size of your will with your friends. You will find some will have a whooping (sic) 19 pages which you may feel puts your small three pager to shame.' A little bit of advice follows, with a final warning that 'one size does not fit all in the wills game'. Fnarr, Fnarr. Meanwhile, the firm also reveals the 'secret to a very, very comfortable old age - score in another's will'. You can only do so if they actually write one but 'for those who can forbear from fighting with relatives and neighbours there is a killing to be made', which is a somewhat unfortunate turn of phrase. Among the many persuasive reasons for making a will, apparently, is the fact that 'there is nothing more satisfying than writing someone out of your will.' Once you have done your will, 'then writing someone out can be done cost effectively by codicil'. All in all, it leaves the Law Society's Make a Will Week initiative seem - despite the best efforts of the (sadly now absent) superhero Will Power - rather tame by comparison.
