Changes to Land Registry cancellation and rejection policy
Since the Land Registry introduced the changes to their policy on rejecting applications and raising requisitions in April, it has received a number of comments from solicitors.
From 7 October, the following changes have been made to the policy.
Where a deed attracts ad valorem stamp duty, it will accept an application where an original deed has not been stamped, provided that:
l At least 20 working days have passed since completion; l A copy of the dated deed is supplied; andl It is clear that the original deed is missing from the application as it has not yet been returned from the Stamp Office.
Apart from this modification, the rejection policy for unstamped deeds remains unchanged.
When a charge is being redeemed, and it is not possible to furnish the DS1 or END within the initial month given in the requisition, the registry will usually extend the period for reply by a further month rather than by the previous two weeks.
