A magistrate who did not ‘express regret’ over 11 penalty points for speeding has been issued a formal warning for misconduct.

The Judicial Conduct Investigations Office found Brian Lawn had committed misconduct by accruing 11 penalty points for speeding offences which he then failed to report to his bench chair. 

The JCIO said the guide to judicial conduct ‘requires judicial office-holders to display a respect for the law and observance of the law’. 

In deciding to issue Lawn with a formal warning, a JCIO spokesperson said: ‘While he paid the penalties for his offences promptly, Mr Lawn did not express regret for the offences. A further aggravating factor was that Mr Lawn failed to comply with his obligation to report the accrual of more than six penalty points on his licence to his senior judicial officer.'
